Women’s Refugee Commission, Human Rights First, and United Stateless File Amicus Brief in Trump v. Casa in Support of Court Orders Blocking the Implementation of President Trump’s Executive Order on Birthright Citizenship

We argue that the Executive Order would render stateless significant numbers of U.S.-born children, including the children of refugee parents whose countries do not recognize them as citizens or who have no way of obtaining documentation of citizenship. We write: “The right to a nationality is itself a fundamental human right enshrined in core international human rights instruments. Statelessness—the lack of a nationality—not only imposes severe impediments on the stateless in nearly every aspect of their lives, it also creates challenges for states.”
